LONDON:A London court has ordered a criminal prosecution of three men who allegedly took part in a scheme to sell counterfeit Viagra.

A trial in Britain's capital has been set for 2 March.

Neilocumented said: "The defendant has been charged with a variety of offences with respect to the operation."

He added: "We are very concerned that the prosecution team should be made aware of the fact that one of the defendants, Mr John Smith, has been a regular customer of this scheme."

The suit, brought by the International Federation of Health-Medicine, Medical Devices and Pharmaceuticals (IFMP), said Smith was involved in the scheme involving the sale of counterfeit medicines and was being made aware of a counterfeit Viagra tablet.

Judge Linda Mulder-Dole, of the London District Court, said that Smith had been convicted twice before and was also a regular customer of the scheme.

"If you can demonstrate that a product has been sold by the person who created it, you can prove that it was in fact purchased from a person who was not Mr Smith and had knowledge of the identity of the person he worked for," she said.

"Mr Smith is not a registered pharmacist and has no contact with customers, nor is he aware of the identity of his clients. The defendants have made a conscious of their business reputation."

The defendant was handed an 11-year prison sentence on October 2011 after he admitted to having taken part in the operation and said he was using a fake product.

A court spokesman said the case had been registered as a provisional trial, which was not an instant one.

The defendants' defence lawyers had asked a judge to give them a suspended sentence on the charges.

"The defendant has not been charged in the provisional trial, the defendant has been given a suspended sentence," said Paul Cairns, defending lawyer.

The case is being prosecuted by a UK-based criminal offences team.

The defendants are being held in the London Tower's Tower 18.30 BST, from 2 March.

The trial has not been set for today.

The court heard that in January, Smith, also known by his trade name John Smith, began selling fake Viagra tablets for personal use.
